These terms govern use of unremarkableart.com, the studio, galleries, generated artworks, digital downloads, physical print orders, provenance certificates, and the administrative right to eject a patron from the premises.

These Terms and Conditions form an agreement between you and Richard Moore trading as Unremarkable Art, covering your access to and use of unremarkableart.com and related services.
By using the service, creating an account, uploading an image, generating artwork, publishing a provenance page, placing an order, or downloading a certificate, you agree to these terms. If you do not agree, do not use the service.

Unremarkable Art lets users upload images, transform them into satirical generated artworks, save them to a private collection, optionally publish gallery or provenance pages, buy digital downloads, order physical print products, and generate provenance certificates.
The fictional institutional voice, Nigel Ponceby-Smythe, and related curatorial copy are part of the creative presentation. They are not promises of artistic, financial, cultural, therapeutic, or legal value.
You must be at least 18 years old, or old enough to enter a binding contract in your jurisdiction, to use the service. You are responsible for keeping your account and sign-in methods secure and for all activity under your account.
We may refuse, suspend, restrict, or terminate access where we reasonably believe an account creates legal, safety, security, abuse, payment, moderation, or operational risk.
You are responsible for every image, filename, title, instruction, message, and other content you submit. You agree that you will not upload, publish, order, or attempt to process content that:
We may remove content, disable sharing, cancel orders, delete sessions, ban accounts, preserve moderation records, and report illegal content where appropriate.
We may also suspend automated or manual fulfilment if we reasonably believe an order contains unlawful, infringing, abusive, unsafe, or provider-prohibited content.
You must own or have permission to use the images and other content you upload. You keep whatever rights you already have in your uploaded content.
You grant us a licence to host, store, process, transform, display, reproduce, resize, watermark, transmit, and otherwise use your uploaded content as needed to provide the service, create generated artworks, operate sharing features you enable, process orders, provide support, enforce these terms, and comply with law.
You confirm that using your upload with our generation, storage, sharing, printing, payment, email, and fulfilment providers will not breach anyone else's rights or any law.
Generated artworks are produced using software, algorithms, and presentation logic controlled by the service. Results vary and may be absurd, imperfect, unattractive, surprisingly good, or all of the above.
We do not guarantee that generated artwork will be unique, free from artefacts, suitable for every use, non-offensive, commercially valuable, legally protectable, or accepted by any third-party platform, printer, payment provider, or recipient.
Provenance certificates, gallery labels, titles, descriptions, and satirical write-ups are creative artefacts for entertainment and gifting. They do not certify market value, authenticity in the traditional art-market sense, legal ownership of source material, or compliance with third-party rights.
The site, brand, copy, design, software, algorithms, artwork engine, certificate templates, gallery presentation, fictional characters, and institutional language are owned by us or our licensors and are protected by intellectual property laws.
You may use the service only as intended. You may not copy, reverse engineer, scrape, resell, or commercially exploit the platform except where we have expressly allowed it.
Payments are processed by Stripe. We do not store full card details. Physical products may be fulfilled by third-party print partners such as Prodigi. Digital downloads are delivered through protected download routes where available.
Prices, products, availability, shipping options, currencies, taxes, and delivery estimates may change. A physical order may require administrative review before submission to a print partner. We may refuse or cancel orders that breach these terms, fail payment checks, contain unacceptable content, or cannot be fulfilled.
You are responsible for providing accurate recipient, delivery, and contact details. We are not responsible for failed delivery caused by incorrect information you provide, refusal of delivery, customs issues, local import rules, or events outside our reasonable control.
Because artworks and print products may be personalised or made to order, cancellation and refund rights may be limited once production has started or a digital file has been made available. By purchasing a digital download, you request immediate supply of digital content and acknowledge that cancellation rights may be lost once the download is made available, to the extent permitted by law.
If a physical product arrives damaged, defective, or materially different from what was ordered, contact hello@unremarkableart.com with order details and photographs so we can investigate with the fulfilment provider.
We may ask for evidence before approving a replacement, refund, or other remedy. We may refuse refunds where the issue was caused by your uploaded image quality, your chosen crop/orientation, incorrect delivery information, misuse, ordinary colour variation between screens and print, or a change of mind after personalised production has begun.
Nothing in these terms affects any statutory consumer rights that cannot legally be excluded.
If you enable public sharing, the relevant artwork or provenance page may be visible to others. You are responsible for deciding whether an artwork should be public. We may disable sharing for moderation, legal, support, abuse-prevention, or operational reasons.
You may not use Unremarkable Art as a general media hosting service. We may block hotlinking, automated scraping, excessive requests, or embedding that bypasses the intended gallery context.
If you believe content on the service infringes your copyright, trade mark, privacy, publicity, or other rights, or if you need to report impersonation, abuse, illegal content, or unsafe material, email hello@unremarkableart.com with the relevant URL, your contact details, the rights or concern involved, and enough information for us to investigate.
We may remove, disable, preserve, or restrict content while we investigate. We may reject incomplete, abusive, fraudulent, or bad faith notices.
We operate a full lockout policy for accounts that upload or attempt to use illegal, harmful, abusive, exploitative, infringing, or otherwise unacceptable content. A banned user may be prevented from signing in, keeping sessions, uploading, publishing, checking out, viewing account pages, accessing paid downloads, or generating certificates.
Admins may still view and manage banned users and their content for moderation, safety, legal, and support purposes. We may disable public artwork sharing for banned accounts.
Where appropriate, we may preserve and disclose information to law enforcement, regulators, payment providers, hosting providers, fulfilment partners, or other relevant bodies to prevent harm, investigate abuse, comply with law, or protect our rights and users.
Your use of the service is also governed by our Privacy Policy, Cookie Policy, and Data Retention page.
The service relies on third-party providers for hosting, databases, storage, authentication, payment processing, print fulfilment, email, analytics, and related infrastructure. We are not responsible for failures, delays, outages, policy changes, or acts of those providers beyond our reasonable control.
The service is provided "as is" and "as available". We do not promise that it will be uninterrupted, error-free, secure, compatible with every device, or capable of producing artwork you like.
We do not provide legal, copyright, moderation, tax, valuation, investment, psychological, relationship, gifting, or art-market advice. You are responsible for checking whether your use of any uploaded image, generated artwork, download, print, certificate, or public page is lawful and appropriate.
We do not guarantee that a gift recipient, social media platform, payment provider, print partner, search engine, public official, art critic, family member, enemy, or neighbour will understand the joke.
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive losses, loss of profit, loss of revenue, loss of data, reputational harm, fulfilment delays, provider outages, or claims arising from content you upload or publish. Our total liability to you for claims arising from the service will not exceed the amount you paid us in the 12 months before the claim, except where the law does not allow that limit.
Nothing in these terms limits liability that cannot legally be limited, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
You agree to reimburse and protect us from claims, losses, damages, liabilities, costs, and expenses arising from your uploaded content, breach of these terms, infringement of third-party rights, unlawful use of the service, or misuse of generated artworks, downloads, certificates, or public pages.
We may update the service, change product availability, alter pricing, modify features, or revise these terms. The latest version will be posted on this page. Continued use after changes means you accept the updated terms.
These terms are governed by the laws of England and Wales. The courts of England and Wales will have jurisdiction over disputes, except where consumer protection law gives you mandatory rights in another jurisdiction.
